OverviewThis commission contracts' (referred to as 'contract', or simply 'terms') purpose is to outline the binding terms between Wyvolf Arts (operator of Wyvolf, "me/my", "I"), and users of my services ("you", the "client") that purchase custom digitally drawn commissions (i.e "commission," "art," "artwork") from me.By entering into a commission contract with me, you state that:~ 1) you agree to my Terms of Service.
~ 2) that this contract is legally binding
~ 3) that you are an adult of 18 years or older. Or 16+ with parental permission.
~ 4) that you understand this contract applies per each piece of commission artwork, and does not establish an exclusive work relationship or friendship.I reserve the right to update this contract and my terms of service at my discretion. Changes to this contract will be effective immediately upon posting the updated terms and will apply to all commission contacts in the future.I reserve the right to refuse to enter a contract and to active contracts at any time.

Art UsageAll artwork and media created by me, Nathan Beagley ['wyvolf'], is subject to copyright protection under law.I retain intellectual property rights and/or artist rights over all of my works. Copyright infringement upon my works will be met with legal action.Claiming credit, artwork ownership, or copyright over my work is strictly prohibited. I reserve the right to make changes to these Terms of Service at any time, which will be effective immediately upon posting the updated terms.I do not allow the personal or commercial use of my works as a whole. This includes but is not limited to: the use of my works as an avatar, profile pictures, or headers on social media; the use of all personal / original characters owned by me and all artworks and media attached to them whether created by myself; the use of my business name, brand identifiers or logo works; tracing, editing, printing or otherwise transforming my artwork; cropping out, drawing over, or erasing my watermarks and signatures; use of the photos and mockups of my works both digital and physical; any and all use of my works in an attempt to pose as me, perform scams, or use in hateful or offensive ways. [Basically: Don't steal or heavily copy my shit)Unauthorized use of my works will be confronted either personally or legally, depending on the severity of the act.I do not consent to any artwork or media created by me being used in or related to in any way, the technologies and market of: AI 'art' generation, any and all cryptocurrencies, or NFT / blockchain-related technology.

Turnaround TimeI work on commissions on weekdays (Monday-Friday), But turnaround times vary depending on how large my queue is, how complex your commission is and/or may be influenced by forces out of my control (I.e. sickness, personal family issues, and other thing that takes me away from working actively).My turnaround time is at least two months maximum, but usually commissions are finished typically within a few days or a week. Animated based commissions; in the sense of fully animated projects (i.e animation memes) may take longer.I will be in contact if things take longer than expected.But as said it largely depends on queue, real life, and the type of commission you ordered. I can do deadlines provided that a set deadline date is addressed during the ordering process.Furthermore, I only do deadlines for birthdays and holiday gifts (Christmas, Hanukkah, Valentines, etc.) and such deadlines must at least give a minimum of a week.To further explain: my work days are between Monday through to Friday, I do not work on commissions on weekends or public holidays in relation to New South Wales, or country-wide events.

Payment TermsPayment for commissioned artwork is accepted via invoice through PayPal OR Ko-FI only, I do not accept payments via other methods at this time.I only accept USD (United States Dollar) and AUD (Australian Dollar), including currency conversions. You will need to provide your email associated with your PayPal for invoicing. Or you may send Payment directly to my buisness PayPal.me address.Payments must be provided upfront and completed in full before I begin working on your commission.Payment plans may be discussed per client, in which I will require a down payment of at least 20% of the total price, and may not exceed a month-long (roughly four weeks) timeframe unless otherwise discussed.If payment is not received within: five days (a week) of involving for single paid in full payments, or by the agreed upon deadline for payment plans, then the commission contract will be cancelled and your slot revoked. Any payment sent for payment plans will be refunded as soon as I am able to.I do not offer private commissions at this time. All my commissions are open to the public.

Commission ProcessA clear, easy to read, or otherwise detailed, visual reference sheet of the character[s] is required. I will not accept written descriptions, messy/very hard to read reference sheets, or otherwise traditionally drawn sheets that do not have a digital palette somewhere.Work in progress ("WIPs") will be sent to the client throughout the commission process for approval and any edit requests. You are allowed to ask for updates and changes at any time. I offer one free total re-sketch of a commission at the sketching stage. After which any major edits will enact an upcharge. (Small, or otherwise minor edits are free).Redlining is perfectly acceptable by the client. However, please keep in mind I will use it as a guide only, as you are commissioning for my art style as I don't copy styles.Turnaround time for most commissions is an estimate between 1–3 months, depending on what is ordered this can be be down within the same week or longer.
With consistent communication expected throughout from both parties. Clients will be notified of any major delays in the turnaround time. Keep in mind that I work Monday-Friday with varying hours, and will usually not check or answer business correspondence on weekends. You must notify me of any deadline requests upon initial discussion of a commission.
As mentioned: ANIMATIONS MAY TAKE LONGER TO COMPLETE.A commission contract is completed upon the approval of the finished product by the client and the transfer of all art work files.

Cancellations & Refund TermsCancellations may be requested by the client or issued by me at any time during the commission process.Cancellation of a contract will include a refund of payment. A 'kill fee' will be deducted from the issued refund equal to the amount of work already completed, as seen below: (This serves as a base example)Not started: client will receive a complete refund
Sketch: client will receive a refund of 70% the total price
Line art: 50% of total price refund.
Color/Rendering: client will receive a refund of 20% the total price.However, no refund will be issued if the commission has been completed.
Tips are non-refundable if they are sent.Clients will not be granted usage permissions to any commissioned artwork which contract has been canceled, no matter the state of completion. Any sketches may be reused for YCHs or simply deleted.
